1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “user”) and Macomber Haddad LLC, doing business as PROCAM (“PROCAM,” “we,” “us,” or “our”). By accessing or using procam.com, our Shopify storefront, or any related services (collectively, the “Site”), you agree to be bound by these Terms.
If you do not agree with these Terms, you may not access or use the Site.
2. Eligibility
You must be at least 18 years old, or the age of majority in your state (including but not limited to Michigan, Ohio, or Illinois), to make purchases, rentals, or place orders on this Site. By using the Site, you represent that you meet all eligibility requirements.
3. Updates to Terms
We may update or modify these Terms at any time. When we do, we will revise the “Last Updated” date at the top of this page. Any changes are effective when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
4. Products, Services & Availability
All products, services, pricing, promotions, and descriptions displayed on the Site are subject to change without notice. We make reasonable efforts to accurately describe items, but we do not guarantee that descriptions, images, or specifications are error-free or complete.
We reserve the right to, at our discretion:
- Limit quantities of any product or service;
- Discontinue any product or service at any time;
- Restrict or refuse service to any person, account, or order;
- Update or correct information at any time without prior notice.
5. Orders, Payments & Verification
By placing an order on the Site, you confirm that all information provided is accurate and complete, and that you are authorized to use the selected payment method. All orders are subject to acceptance and availability.
We may, at our discretion:
- Refuse or cancel any order;
- Limit or cancel quantities purchased per person, per household, or per order;
- Request additional verification or identification before accepting an order.
Accepted payment methods are shown at checkout and may include Shopify Payments, major credit and debit cards, PayPal (if enabled), financing partners, and other methods supported by our platform.
6. Pricing, Errors & Corrections
We make every effort to ensure accurate pricing and information. However, errors may occur. In the event of any error relating to price, availability, or product information, we reserve the right to:
- Correct the error;
- Cancel any affected order; or
- Contact you with options before proceeding.
If your payment has already been processed for a canceled order, we will issue a full refund to the original payment method.
7. Shipping & Delivery
Shipping methods, options, and estimated delivery times are shown at checkout and may vary by location, product, or carrier. Shipping times are estimates and are not guaranteed.
Risk of loss and title to products pass to you when the order is delivered to the carrier. We are not responsible for:
- Delivery delays caused by carriers or events beyond our control;
- Lost, stolen, or damaged packages after transfer to the carrier;
- Incorrect or incomplete shipping addresses provided by you.
8. Returns & Exchanges
Our Return Policy, as posted on the Site, is incorporated into these Terms by reference. By placing an order, you acknowledge that you have reviewed and agree to the Return Policy applicable at the time of purchase.
Certain products and services are non-returnable or may be subject to restocking fees, including but not limited to:
- Film processing and development services;
- Custom prints, scanning, and archiving services;
- Special orders, closeout, clearance, or “final sale” items;
- Rental fees and related charges.
We reserve the right to refuse returns that do not comply with the posted Return Policy.
9. Used, Open-Box & Clearance Items
Used, open-box, pre-owned, and clearance items are sold in the condition described at the time of sale and may show signs of use, cosmetic wear, or missing accessories. Unless expressly stated otherwise:
- These items are sold “AS-IS”; and
- No additional warranties are provided by PROCAM beyond what is stated at sale.
10. Warranties
Many new products include a manufacturer’s warranty. The terms, duration, and coverage of manufacturer warranties are determined solely by the manufacturer. PROCAM does not modify, extend, or assume responsibility for manufacturer warranties.
Extended warranties or protection plans, if offered, are subject to the terms and conditions of the issuing provider. Coverage, exclusions, and claim handling are determined by that provider.
EXCEPT AS EXPRESSLY PROVIDED BY APPLICABLE MANUFACTURER WARRANTIES OR WRITTEN PROCAM POLICIES, ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY ADDITIONAL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
11. Accounts
When you create an account on the Site, you are responsible for maintaining the confidentiality of your login information and for all activities that occur under your account. You agree to notify us promptly of any unauthorized access or use.
We may suspend or terminate your account at our discretion for any reason, including suspected fraud, misuse, or violation of these Terms.
12. Prohibited Activities
You agree that you will not:
- Use the Site for any unlawful, fraudulent, or abusive purpose;
- Interfere with or disrupt the Site or its security;
- Use automated tools (such as bots, scrapers, or crawlers) without our prior consent;
- Attempt to reverse-engineer, modify, or tamper with any part of the Site;
- Submit false information or impersonate another person or entity.
13. User Content & Reviews
If you submit reviews, comments, photos, or other content (“User Content”), you grant PROCAM a non-exclusive, royalty-free, worldwide license to use, reproduce, adapt, publish, translate, and display such content in connection with our business, including for marketing and promotional purposes.
You are solely responsible for your User Content and represent that it does not violate any third-party rights or applicable law. We reserve the right to edit or remove User Content at our discretion.
14. Third-Party Links
The Site may include links to third-party websites or services. These links are provided for convenience only. PROCAM does not endorse, control, or assume responsibility for third-party content, privacy practices, or policies. Your use of third-party sites is at your own risk.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING IN MICHIGAN, OHIO, AND ILLINOIS, PROCAM, MACOMBER HADDAD LLC, OUR OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES;
- LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY;
- DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SITE OR PRODUCTS;
- DAMAGES RESULTING FROM CARRIERS, MANUFACTURERS, OR THIRD-PARTY SERVICE PROVIDERS.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE, PRODUCTS, OR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR SERVICE AT ISSUE.
16. Indemnification
You agree to indemnify, defend, and hold harmless PROCAM, our owners, officers, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Site, products, or services;
- Your breach of these Terms;
- Your violation of any law or third-party rights.
17. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. If required by law, transactions fulfilled in Ohio or Illinois may also be subject to the consumer protection laws of those states.
Subject to applicable law, you agree that any legal action relating to these Terms or your use of the Site shall be brought in the state or federal courts located in Wayne County, Michigan.
18. Termination
We may suspend or terminate your access to the Site, your account, or any order at any time, with or without cause or prior notice. Upon termination, your right to use the Site will cease immediately.
Provisions of these Terms that by their nature should survive termination (including but not limited to payment obligations, warranty disclaimers, limitations of liability, and indemnification) will continue to apply.
19. Privacy Policy
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Site, you consent to our data practices as described in the Privacy Policy.

21. Rental Services
By renting equipment from PROCAM, whether in-store or through the Site, you agree to the rental terms below in addition to all other applicable Terms.
21.1 Rental Eligibility
To rent from PROCAM, you may be required to:
- Be at least 18 years of age;
- Present a valid government-issued photo ID;
- Provide a valid physical credit card in your name;
- Agree to any additional rental documentation or forms.
21.2 Security Deposits
A refundable security deposit may be required depending on the total replacement value of the rented equipment, your rental history, or insurance coverage. Deposits are typically held on your card and released after the equipment is returned and inspected, provided there is no damage, loss, or missing items.
21.3 Condition of Rented Equipment
You agree that you have had an opportunity to inspect the equipment upon pickup and that it is in good working order. You agree not to:
- Alter, modify, or disassemble the equipment;
- Use the equipment in hazardous or illegal activities;
- Sub-rent or transfer the equipment to another party without consent.
21.4 Damage, Loss, or Theft
You are responsible for the equipment from the time it leaves our possession until it is returned and checked in. This includes responsibility for:
- Accidental damage;
- Negligent or improper use;
- Theft or loss;
- Missing accessories, caps, cables, or cases.
Damage or loss may result in charges up to the full replacement value of the equipment, plus applicable fees.
21.5 Late Returns
Rentals must be returned on or before the agreed return date and time. Late returns may incur additional rental charges or late fees. Extended or overdue rentals without communication may be treated as lost or stolen.
21.6 Insurance
We may require proof of equipment rental insurance, or security deposits, for certain rentals. Insurance must typically cover theft, accidental damage, and physical loss. It is your responsibility to understand and comply with your insurance provider’s terms.
22. Film Processing Services
By submitting film, negatives, disposable cameras, or similar media for processing or development, you agree to the following terms specific to film services.
22.1 No Guarantee of Results
The nature of film means that color, density, sharpness, and overall image results can vary and may be affected by factors outside of our control, including how the film was stored, exposed, or previously handled. We cannot guarantee that images will be free from defects or match any specific expectation.
22.2 Liability for Film
If film or related media is lost, damaged, or destroyed while in our possession, our maximum liability is limited to:
- Replacing the film (where available), or
- Refunding the processing charges paid for that roll or batch.
We are not responsible for any sentimental, professional, or consequential damage arising from loss of film or images.
22.3 Turnaround Times
Turnaround times for film processing are estimates and may vary based on demand, equipment, and any third-party services involved. We are not liable for delays in processing.
23. Printing, Scanning & Archiving Services
PROCAM offers printing, scanning, restoration, and archiving services for digital images, film, and physical media. By using these services, you agree to the following:
23.1 Rights to Submitted Content
You represent and warrant that you have all necessary rights, permissions, and authority to submit images, film, or other content to us for printing, scanning, or archiving. You agree not to submit content that:
- Infringes on any copyright, trademark, or privacy right;
- Is unlawful, harmful, or inappropriate;
- Violates any applicable law or regulation.
23.2 Color & Output Variations
We make reasonable efforts to produce accurate and pleasing prints and scans. However, final output may differ from on-screen previews or previous prints due to differences in devices, color spaces, paper types, and lighting conditions. We do not guarantee an exact match to any specific reference.
23.3 Customer-Supplied Media
When you provide physical media (film, prints, negatives, memory cards, drives, etc.), you do so at your own risk. Our maximum liability for loss, damage, or destruction of such media is limited to a refund of the service fees paid for the specific job. We are not responsible for:
- Loss of digital files or data;
- Corrupted or unreadable media;
- Any consequential damages related to lost images or files.
24. Financing Programs
We may offer financing, lease-to-own, or installment options through third-party providers (such as Affirm, Shop Pay Installments, or other partners). These programs are subject to approval and terms set by the provider, not by PROCAM.
24.1 Third-Party Financing Terms
Any financing agreement you enter into is solely between you and the financing provider. PROCAM is not a party to, and is not responsible for, the financing contract, credit approval, interest rates, fees, or repayment schedule.
24.2 Credit Review & Approvals
Approvals, denials, and credit decisions are made by the financing provider, not PROCAM. We cannot influence or change credit decisions.
24.3 Fees & Refunds
Any fees, interest, or charges from the financing provider are not refundable by PROCAM. In the event of a product return, any refund will be processed according to our Return Policy and the financing provider’s terms.
25. Trade-In & Gear Buyback
PROCAM may offer trade-in or buyback programs for cameras and related equipment. Participation in these programs is subject to the following:
25.1 Estimates & Final Evaluation
Any trade-in quote or estimate provided online, over the phone, or via email is a preliminary estimate only. The final value is determined after in-person inspection, testing, and verification of the item’s condition and functionality.
25.2 Condition Assessment
Trade-in or buyback value depends on, among other things:
- Cosmetic condition (scratches, dents, wear);
- Mechanical and electronic functionality;
- Shutter count or usage where applicable;
- Sensor cleanliness or damage;
- Included accessories (batteries, chargers, caps, boxes, etc.).
25.3 Items We May Decline
We reserve the right to refuse or decline to purchase:
- Heavily damaged or non-working items;
- Items with significant water or impact damage;
- Obsolete equipment or products without resale demand.
25.4 Final Offer
Once you accept our final trade-in or buyback offer and the transaction is completed (cash, check, or store credit issued), the sale is final and the item becomes the property of PROCAM.
26. Warranty Programs & Protection Plans
PROCAM may offer extended warranty or protection plans through third-party providers, in addition to any manufacturer warranties on new products.
26.1 Manufacturer Warranties
Most new products include a manufacturer warranty. The coverage, duration, and claim process are determined solely by the manufacturer. You are responsible for retaining proof of purchase and contacting the manufacturer or its authorized service centers for warranty service.
26.2 Extended Warranties & Protection Plans
If you purchase an extended warranty or protection plan, the terms of that plan are governed by the issuing provider. These plans may have specific coverage, limits, exclusions, and claim procedures which you should review carefully.
26.3 Common Exclusions
Warranty programs typically do not cover:
- Physical damage from drops, impacts, or misuse (unless specifically included);
- Water, sand, or environmental damage (unless specifically included);
- Consumables such as batteries, lamps, foam, and cables;
- Cosmetic wear that does not affect functionality.
26.4 Warranty Limitations
PROCAM is not responsible for the approval or denial of warranty claims, the time required to obtain parts or perform repairs, or any decisions made by the manufacturer or warranty provider.
27. Repair Services
By submitting equipment for repair or maintenance services—whether in-store or via mail-in—you agree to the following terms in addition to all other provisions of these Terms.
27.1 Repair Eligibility
Repairs may be performed by PROCAM technicians, authorized third-party repair partners, or manufacturer-certified service centers, depending on the equipment and required work. We reserve the right to decline any repair request at our discretion.
27.2 Diagnostic Evaluation
Before repair, equipment may undergo a diagnostic evaluation. You authorize PROCAM and our repair partners to open, inspect, and test the equipment as needed to assess the issue. Diagnostic fees, if applicable, will be disclosed beforehand and may be non-refundable.
27.3 Repair Estimates
Any repair estimate is a good-faith estimate based on the information available at the time. Actual repair costs may change if:
- Additional issues are discovered during the repair process;
- Parts availability or pricing changes;
- Manufacturer or service center pricing changes.
You will be contacted for approval before any repair is performed that would exceed the approved estimate.
27.4 Parts & Turnaround Times
Turnaround times for repairs are estimates only and may be affected by technician workload, manufacturer delays, parts availability, or shipping times. PROCAM is not liable for delays outside of our control.
27.5 Customer Responsibility
You are responsible for:
- Backing up any data, files, or images stored on devices or memory cards;
- Removing accessories not required for the repair (e.g., straps, cards, filters);
- Informing us of prior repairs or relevant history of the equipment.
PROCAM is not responsible for loss or corruption of data, memory cards, or files, or for cosmetic damage that is pre-existing or unrelated to the repair.
27.6 Liability for Damage or Loss
While we take care in handling all equipment, our maximum liability for loss, theft, or damage to your equipment while in our possession is limited to the lesser of:
- The repair cost paid to us; or
- The current replacement value of the equipment (as reasonably determined by us).
We are not responsible for any sentimental, professional, or consequential damages associated with the loss of use of your equipment or images.
27.7 Unclaimed Repairs
If your repaired equipment is not picked up within 60 days of the date we notify you that it is ready, it may be considered abandoned. We may, after reasonable attempts to contact you:
- Dispose of the equipment;
- Sell the equipment to recoup repair and storage costs; or
- Arrange return shipment at your expense, if previously agreed.
27.8 Warranty on Repairs
Repairs completed directly by PROCAM may include a limited warranty on the specific repair work performed, for a defined period that will be disclosed at the time of service. This limited repair warranty:
- Does not cover new or unrelated issues that arise after the repair;
- Does not cover subsequent physical, water, or impact damage;
- May not apply to certain types of equipment or repairs, as noted on your work order.
Repairs performed by third-party or manufacturer service centers are subject to their own warranty terms, not PROCAM’s.
27.9 Manufacturer Warranty Repairs
If your equipment is covered under a manufacturer warranty, eligibility for warranty repair is determined solely by the manufacturer. We cannot override or change manufacturer decisions. Unauthorized modifications or previous damage may void warranty coverage.
Any shipping, handling, or service fees not covered by the manufacturer are your responsibility.
27.10 Mail-In Repairs
For mail-in repair services, you are responsible for properly packaging your equipment and shipping it to us. We are not liable for damage caused by improper packaging or shipping carriers. Return shipping and insurance may be billed to you unless otherwise specified.
